Pinky's family cleared in Forex-3D case, relatives freed

Actress Savika “Pinky” Chaiyadech, her mother Sarinya Chaiyadech and her brother Kittichet Chaiyadech were acquitted on 13 August 2026 in the long-running Forex-3D fraud case, ending years of legal uncertainty for the family. The Criminal Court on Ratchadaphisek Road cleared the three relatives along with 17 other defendants, while the scheme's former CEO and four others received heavy prison sentences.

The ruling means Pinky's mother and brother, who had remained in custody, were set to be released from prison. Pinky said she was extremely happy that the court had given justice and acquitted everyone in her family, and that she would go immediately to wait for her mother and brother to come out of prison.

Why the court acquitted the family

The court found that Pinky and her family were only investors who put money into the scheme in the normal way. There was no behaviour showing that they acted as recruiting team leaders or received abnormally high returns compared with ordinary investment terms.

Defence lawyer Phisit Chutipornpongchai said the court had spent five years examining evidence in the case and about seven hours considering the judgment on the day. The remaining 17 acquitted defendants were described as company employees or family members the court found were not involved in running the business.

The convictions in the same case

In contrast, the court sentenced defendant 1 Apiruk Kothi, the former CEO of Forex-3D, and defendants 5, 9, 11 and 21 to 49,110 years imprisonment each, with the maximum actual imprisonment capped at 20 years under Thai law.

Defendant 21, Kookki Pakamon Silun, is the ex-wife of Apiruk Kothi and girlfriend of actor Prabpadol Suwanbang. The court found the prosecution evidence clearly showed Apiruk committed the alleged offences of soliciting and defrauding the public, as well as borrowing money that defrauded the public.

Repayment and fines ordered

The court ordered the convicted defendants to jointly repay actual damages to the victims with 7.5% interest. It also fined juristic-person defendants 2 and 3 a total of 4,911 million baht each.

What the Forex-3D scheme was

Forex-3D was operated by RMS Famelia Co. Ltd., located on the 20th floor of the AIA Building on Ratchada 3 Road in Din Daeng, Bangkok, with Apiruk Kothi as owner. The scheme solicited members to invest in foreign-exchange trading by claiming it used an accurate AI trading system.

A long road for the family

In August 2022, Pinky, her mother Sarinya Chaiyadech and her brother Sarayuth Chaiyadech were sent to prison. Pinky spent more than three months in prison before the Criminal Court granted her temporary release in November 2022 on 5 million baht bail, with conditions including a ban on foreign travel and monthly reporting to the court.

Her mother and brother remained in custody until the acquittal. The verdict closes the family's involvement in the case, while the convicted defendants still face an appeal.
