The Commodity Futures Trading Commission (CFTC) has once again demonstrated its commitment to safeguarding American citizens from potential financial fraud. In its latest action, the CFTC has integrated an extra 45 unregistered foreign entities into the Registration Deficient List, otherwise known as the RED List.
Director of Enforcement, Ian McGinley, underlined the importance of the RED List, which has been instrumental for almost a decade. “The RED List has identified potential financial threats to Americans for nearly ten years. Therefore, we emphatically advise all traders to verify the RED List before engaging in any trade. Trading with unregistered firms that operate outside the U.S. could result in limited or no protections.”
Initiated in 2015, the RED List of the CFTC currently includes over 240 entities. The incorporation of a firm to this list happens when the CFTC, based on investigation findings and public inquiries, determines that a particular firm has failed to register with the CFTC, despite operating in a capacity that necessitates such registration. This could involve activities such as trading binary options, forex, or other similar products.
The Commodity Exchange Act usually requires derivatives sector intermediaries to register with the CFTC. An “intermediary” is a person or company that represents another party in the trading of futures, swaps, or options. Intermediaries may also be subject to a number of financial, disclosure, reporting, and recordkeeping requirements, depending on their unique operations. However, there may be certain exclusions or exemptions for intermediaries, which means they are not needed to register. Entities on the RED List, however, do not qualify for such exceptions or exemptions.
The RED List is distributed to several partners in the financial industry. This includes regulators, consumer groups, industry participants, self-regulatory organizations, exchanges, and industry associations. It supplements registration information supplied by the National Futures Association.
The general public also plays a vital role in providing information on entities that should be considered for the RED List.
